This Privacy Policy ("Policy") will help you understand how Voloridge Health, LLC (“Voloridge Health”, “us”, “we”, “our”) collects, uses, discloses and protects the data you provide to us when you visit and use our website, apps and related online or offline services we offer (collectively, the “Services”). This Policy also describes your choices about the collection and use of your information.
THIS POLICY APPLIES TO THE BETA VERSION OF OUR SERVICES AND WILL BE UPDATED WHEN THE BETA PERIOD ENDS. CONTINUED USE OF THE SERVICES AFTER THE BETA PERIOD ENDS CONSTITUTES ACCEPTANCE OF THE UPDATED POLICY.
Please read this Policy carefully before you start to use our Services. By using the Services, you agree to be bound and abide by our posted Terms of Use (the “Terms”) and this Policy. If you do not agree to the Terms and this Policy, or if you violate them in any way, your right to access or use the Services is terminated. PLEASE SEE SECTIONS 12-14 IN OUR TERMS REGARDING YOUR LEGAL RIGHTS IN ANY DISPUTE INVOLVING OUR SERVICES, INCLUDING MANDATORY ARBITRATION AND A WAIVER OF RIGHTS TO A JURY TRIAL OR CLASS ACTION.

Genetic Information is information and data related to your DNA, which we may receive from our genetic testing partners and/or existing genetic test results provided by you or on your behalf.

Health Indicators is information and data related to your blood tests, urine tests, saliva tests or similar tests that are performed by our laboratory partners and/or existing test results provided by you or on your behalf.

Self-Reported Information is information you provide to us through wearable devices, medical records you request or otherwise authorize for transmission to us, from questionnaires or in any surveys, forms, journal entries, etc. and may include sex, body weight, height, diet and device monitoring results (e.g., heart rate, blood pressure, sleep pattern).

Survey information is information you provide to us in response to questions we may send you in connection with the Services, including for feedback and research purposes.

Communications is information we obtain from communications between you and us, such as via email, mail, phone, or other channels.

Offline activity is information you provide through direct engagement with us.

Online User Activity is the information described in the next section.
If you provide us with information regarding another individual, you represent that you have the right to do so and that person’s consent to give us his or her information and to permit us to use the information in accordance with this Policy.
Electronic Health Records Disclaimer. AT NO TIME SHALL YOUR INFORMATION BE DEEMED TO BE PROTECTED HEALTH INFORMATION, AN ELECTRONIC HEALTH RECORD, OR AN ELECTRONIC MEDICAL RECORD FOR ANY PURPOSE, INCLUDING WITHOUT LIMITATION FOR THE PURPOSE OF COMPLIANCE WITH THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996 (“HIPAA”).
3. Online User Activity, Cookies and Information Collected by Other Automated Means
Cookies are a commonly used web technology that allow websites to store and retrieve certain information on a user’s system, and track users’ online activities. We, together with vendors we use, may collect information about your use of our Services by such automated means, including, without limitation, cookies, pixels, SDKs and other similar technologies.
Cookies and similar technologies can help us automatically identify you when you return to our Services. Cookies help us review website traffic patterns, improve the Services, and determine which Services are popular. We can also use such information to deliver customized content and advertising to users of the Services whose behavior indicates that they are interested in a particular subject area.

Because there is not yet a consensus on how companies should respond to web browser-based do-not-track (“DNT”) mechanisms, we do not respond to web browser-based DNT signals at this time.

Provide our Services to you, including to maintain your Account, to conduct health- and fitness- related analyses (which may include ratings or scorings, assessment of genetic potential for certain traits, etc.), manage any interactions or transactions, provide important notices, respond to inquiries, questions and comments and provide customer support;

Monitor the performance of our online Services including metrics such as total number of visitors, traffic, and demographic patterns;

Tailor the content we display to you in our online Services and communications, including with respect to products that may be of interest to you;

Run promotions, contests, surveys, or other features of the Services. We do not use Blood Information, Genetic Information or Self-Reported Information for marketing purposes.

Operate, evaluate and improve our Services and other products and services we offer (including to develop new services), and diagnose or fix technology problems;

Analyze and enhance our communications and strategies;

Inform you about changes to this Privacy Policy and our Terms and other policies; and

Comply with and enforce as needed applicable legal requirements, industry standards, our policies and our contractual rights, as needed for security purposes, and to investigate possible fraud or safety issues.
We may also use or share information in an anonymized or aggregate manner for many purposes such as research, analysis, modeling, marketing, and improvement of our Services. For example, we may anonymize and de-identify (i.e., remove identifying information from) Blood Information, Genetic Information and Self-Reported Information for our own research purposes or disclose it to third parties for research or other applications. Our research is intended to advance health and wellness knowledge and to create, and commercialize products or services, or undertake other commercial activities. Our research partners may include commercial or non-profit organizations that conduct or support health, wellness and medical research or conduct or support the development of drugs or devices to diagnose, predict, or treat health conditions.
In some instances, we may ask permission to use your personal and/or de-identified information for research that we hope to publish in scientific publications or in some other context. If you agree to allow us to use your information, you will be asked to provide express written consent (“Research Consent”) giving us permission to use your information for the described purposes. Research Consents are voluntary, and you do not need to provide a Research Consent to use the Services.
5. How We Share Your Information
We will not disclose your personal information without consent, except in the following circumstances:

As discussed above, certain Online User Activity may be shared through third party targeted advertising cookies or other tools, but subject to opt-out functionality.

Your contact and shipment information (including content descriptions) may be shared with common carriers for transporting materials between you and us.

We may share your information with service providers that we believe need the information to perform a technology, business, or other professional function for us (examples include testing partners, IT services, maintenance and hosting of our Services, payment processors, shipping and returns partners, marketing partners, and other service providers). We only provide such vendors with information so they can perform their required functions on our behalf.

We also may disclose information about you (i) if we are required to do so by law or legal process, (ii) when we believe disclosure is necessary to prevent harm or financial loss, (iii) in connection with an investigation of suspected or actual fraudulent or illegal activity; or (iv) under exigent circumstances to protect the personal safety of our staff, users or the public.

We reserve the right to transfer the information we maintain if we sell or transfer all or a portion of our business or assets. If we engage in such a sale or transfer, we will make reasonable efforts to direct the recipient to use your personal information in a manner that is consistent with this Privacy Policy.
Note that we do not share your text message program enrollment or consent with third parties for their own purposes.
If you choose to use Social Login (e.g., Apple, Google, Facebook) to create or access your Account, you understand that some limited information regarding your activity may be accessible to that third party provider because of such use.
Where appropriate, we will limit the sharing of your information in accordance with the choices you have provided to us and consistent with applicable law.
6. Your Privacy Choices
We offer you certain choices about what information we collect from you, how we use and disclose the information, and how we communicate with you.

Marketing Emails: From time to time, we may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. You may choose not to receive marketing emails from us by clicking on the unsubscribe link in the marketing emails you receive from us. Even if you opt out of receiving such communications, we will continue sending you non-marketing email communications, such as administrative or transaction alerts, or information about changes to our Terms.

Text messages: If you affirmatively consent to receive text messages from us and enroll in such a program, you will receive updates via text unless you opt-out of the text message program. These messages may be unencrypted. Message frequency may vary based on the Services. If at any time you would like to stop receiving text message notifications, please text “STOP” in reply to our message, we will send you a reply message to confirm that you have been unsubscribed and you will no longer receive messages from us. If you want to join again, just sign up as you did the first time, and we will start sending messages to you again. If at any time you forget what keywords are supported, just text “HELP” back to us and we will respond with instructions on how to use our service as well as how to unsubscribe.

Mobile accounts: If you create an Account through one of our mobile apps, you may delete your account and request deletion of your information where indicated or by contacting us.

Cookies: Web browsers may offer users the ability to disable receiving certain types of cookies; however, if cookies are disabled, some features or functionality of our Services may not function correctly.

Device settings: Your device may enable you to disable certain permissions or functionality in our Apps (e.g., location); however, when necessary permissions or functionality are disabled, some features or functionality of our website may not function correctly. You can also disable pop-up notifications in device settings.
Certain privacy laws may provide additional rights with respect to the collection and use of personal information collected by businesses, including requests to: (i) disclose personal information maintained about the individual; (ii) correct or delete personal information maintained about the individual (subject to certain exceptions); (iii) withdraw consent or require that we cease processing your sensitive personal information, in some circumstances; or (iv) not sell personal information about the individual to a third party (excluding qualified service providers). It can be unlawful to discriminate against an individual for exercising such rights. You can submit such requests to us via the contact information provided below and following necessary verifications, we will endeavor to fulfill any obligations that are legally required, otherwise we will endeavor to accommodate such requests subject to our reasonable discretion.
Your use of the Services is voluntary, and you may cancel your Account at any time. If for any reason you believe that your use is not voluntary, please stop all use of the Services. If you no longer wish to use the Services, you may close your Account by sending a request to support@voloridgehealth.com. When closing an Account, we remove certain personal information from your Account, but information that you previously provided may not be removed from ongoing or completed research and development or business activities already using that information, to the extent permitted by law. Similarly, if you close your Account after providing a Research Consent, any information subject to that content may continue to be used as provided therein and permitted by law. If you wish to have your information removed by any of our partners that you interacted with, you must contact them separately to make the request. We will generally keep limited information related to order history (e.g., name, contact, and transaction data) for accounting and compliance purposes, to the extent permitted or required by law.
7. Consumer Health Privacy Disclosure
Under the Washington My Health My Data Act (MHMDA) and similar laws by other U.S. states, to the extent applicable, individuals have the right to receive certain disclosures regarding a business’s processing of “consumer health data,” as defined under the MHMDA, as well as certain rights with respect to processing of such consumer health data.

Sources we collect consumer health data from include you, your devices and third parties you authorize to share information with us.

The purposes for collection and how we use consumer health data are described above and primarily include the provision of our Services to you and for aggregated research purposes.

We may share your consumer health data with third parties only to the extent permitted by law, and primarily to provide you with the services you request, for any other purpose for which you provide consent, or as necessary to comply with applicable law.

Where you are a consumer and we collect, use or share consumer health data subject to MHMDA or a similar U.S. state law, you may have the following rights under the MHMDA with respect to your consumer health data, subject to applicable exceptions: (i) the right to confirm whether or not we are processing your consumer health data and to access such consumer health data; (ii) the right to ask us to delete certain consumer health data we have collected about you; and (iii) to the extent you consent to collection or sharing of consumer health data, you have the right to withdraw that consent at any time.
You can submit such requests to us via the contact information provided below and following necessary verifications, we will endeavor to fulfill any obligations that are legally required, otherwise we will endeavor to accommodate such requests subject to our reasonable discretion.
8. Links to Other Websites and Third-Party Content; Online Advertising
Our Services may contain links to other websites or online services, including social media. Please be aware that we are not responsible for the content or privacy practices of such other websites or online services, and we encourage you to be aware when you leave our Services and to read the privacy statements of any other website or online service that collects personal information.
You may see us promoted by other businesses on various websites, web pages, social media and other platforms. Please note that we do not always have complete information about where our brand may be displayed, promoted or advertised, and if you believe that we are featured in any manner that is inappropriate or offensive, please contact us.

We endeavor to maintain reasonable administrative, technical and physical safeguards designed to protect the personal information we maintain against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. However, WE CANNOT ENSURE THE SECURITY OF ANY INFORMATION YOU TRANSMIT TO US, OR GUARANTEE THAT THIS INFORMATION WILL NOT BE ACCESSED, DISCLOSED, ALTERED, OR DESTROYED. We will make any legally required disclosures in the event of any compromise of personal information. To the extent the law allows us to provide such notification via e-mail or conspicuous posting on the Services, you agree to accept notice in that form.
IF YOU SHARE ANY BLOOD INFORMATION, GENETIC INFORMATION, SELF-REPORTED INFORMATION OR OTHER PERSONAL INFORMATION WITH ANYONE, YOU DO SO AT YOUR OWN RISK. We have no responsibility or liability for any consequences that may result from your sharing or releasing any of your information. It is your responsibility to share such information only with people you know and trust.
10. Children
We do not knowingly collect personal information from anyone under 18 years old on our Services. If you believe that a minor provided personal information to us through the Services, please notify us. If we learn that we have received personal information from a minor, we will endeavor to promptly delete that information.
11. Updates to Our Privacy Policy
We may revise or update this Policy at any time by posting the updated version on our Services. We may also notify you via email about changes to this Policy. We will indicate on this Policy when it was most recently updated. Your continued use of our Services after such updates will constitute an acknowledgment of the change and agreement to abide and be bound by the updated Privacy Policy.
